Welcome to Flickie. These Terms of Service (“Terms”) govern your use of the website at flickie.xyz (the “Service”), operated by an independent individual (“Flickie,” “we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

What Flickie is

Flickie is an entertainment service that lets you vote in head-to-head matchups between athletes and see aggregated rankings based on the votes of all users. Rankings reflect the collective opinions of Flickie’s users. They are for entertainment and discussion purposes only and are not statements of fact about any person’s actual ability, achievements, or worth.

Eligibility

You must be at least 13 years old to use the Service. By using Flickie, you represent that you are at least 13 and that you are able to form a binding agreement.

Your account

To vote and save your activity, you sign in using your Google account. You are responsible for:

• Keeping your account secure.
• All activity that occurs under your account.
• Making sure the information associated with your account is accurate.

You may stop using the Service at any time, and you may request deletion of your account by contacting us at the email below.

Acceptable use

When using Flickie, you agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to manipulate, distort, or artificially influence votes or rankings, including through automated means, bots, scripts, or multiple accounts.
• Attempt to gain unauthorized access to the Service, other users’ accounts, or our systems.
• Interfere with, disrupt, overload, or attempt to disable the Service.
• Copy, scrape, harvest, or extract data from the Service except as expressly permitted.
• Use the Service to harass, abuse, or harm others.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are harming the Service or other users.

Content and rankings

The players, matchups, rankings, and other materials made available through the Service are provided for entertainment. Rankings are generated from user votes and change over time. We make no representation that any ranking is accurate, complete, or reflects any objective measure of a person’s abilities or accomplishments.

Player names and related factual information may be drawn from publicly available sources. We do not claim any affiliation with, endorsement by, or sponsorship from any athlete, team, league, or organization referenced on the Service.

Intellectual property

The Service, including its design, branding, layout, and original content, is owned by Flickie and protected by applicable laws. You may not copy, reproduce, or reuse the Service or its original content without our permission, except as allowed by these Terms or applicable law.

Availability and changes

Flickie is an evolving project. We may add, change, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee that the Service will always be available, uninterrupted, or error-free.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your expectations or that it will be secure, uninterrupted, or error-free.

Limitation of liability

To the fullest extent permitted by law, Flickie and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US$100).

Indemnification

You agree to indemnify and hold harmless Flickie and its operator from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service or your violation of these Terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Provisions of these Terms that by their nature should survive termination will survive.

Governing law

These Terms are governed by the laws of the United States and the state in which the operator resides, without regard to conflict-of-law principles. Any disputes will be handled in the appropriate courts located there, unless otherwise required by applicable law.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Effective date” above and post the revised Terms on this page. Your continued use of the Service after changes take effect means you accept the updated Terms.
